General Terms and Conditions of Sale<\/strong><\/p>\n

These General Terms and Conditions of Sale (hereinafter the \u201cTerms and Conditions\u201d), dated October 1, 2020, shall apply as of October 1, 2020. They may be amended at any time without prior notice. These Terms and Conditions govern all sales made through the website www.bazncamp.com by the company identified in the Legal Definitions & Notices section.<\/p>\n

Legal Definitions & Notices<\/strong><\/p>\n

These Terms and Conditions are offered by BAZ\u2019N CAMP, an association registered with the BOUCHES-DU-RHONE Prefecture under number W833004098, whose registered office is located at Cit\u00e9 des Associations No. 348 \u2013 93 La Canebi\u00e8re, 13001 Marseille (hereinafter \u201cBAZ\u2019N CAMP\u201d). These General Terms and Conditions of Sale (Terms and Conditions) apply to all services offered by BAZ\u2019N CAMP. By registering for one of the programs offered by the association, the participant or their legal representative accepts these Terms and Conditions without reservation.<\/p>\n

<\/strong><\/p>\n

1. Programs Offered<\/strong><\/p>\n

BAZ\u2019N CAMP offers several sports support and development programs:<\/p>\n

\u00b7 Training camps in France in Marseille and Paris, and in the United States in Santa Barbara: residential (including accommodation) and non-residential (without accommodation).<\/p>\n

\u00b7 Camps in the United States: participation in a program including travel to the United States, departing from France, with support from BAZ\u2019N CAMP to compete against teams in the United States.<\/p>\n

\u00b7 Personalized Support Program: an individual 9-month program designed to support the participant in their athletic development and personal project, including individual video-conference sessions, an end-of-season assessment, access to online training sessions, a highlights video, and expert sessions in the sports business field.<\/p>\n

The details and characteristics of each service are specified in the relevant program description and in the order summary.<\/p>\n

<\/strong><\/p>\n

1 bis. Personalized Support Program<\/strong><\/p>\n

The Personalized Support Program is offered for a period of 9 months at a price of \u20ac995 including VAT.<\/p>\n

It notably includes:<\/p>\n

\u00b7 8 individual 1.5-hour video-conference sessions with an English- or French-speaking coach;<\/p>\n

\u00b7 1 end-of-season assessment;<\/p>\n

\u00b7 unlimited access to online training sessions via the Blueprints premium application;<\/p>\n

\u00b7 production of a highlights video based on videos provided by the participant;<\/p>\n

\u00b7 2 Sports Business expert sessions with industry professionals.<\/p>\n

The participant may also subscribe to the Performance Pack Option, offered at a price of \u20ac390 including VAT for 9 months. This option notably includes an initial fitness assessment, a physical training program organized into 3 quarterly cycles, as well as regular follow-up with a French strength and conditioning coach.<\/p>\n

The specific arrangements for organizing the sessions and services will be communicated to the participant upon registration.<\/p>\n

<\/p>\n

2. Participation Requirements<\/strong><\/p>\n

\u00b7 Participants, or their legal representatives, declare that they have obtained medical authorization allowing them to practice basketball intensively, both in training and competition. This authorization certifies that the participant is fit to engage in demanding physical activities related to basketball, in accordance with the recommendations and prescriptions of their healthcare professional.<\/p>\n

\u00b7 Participants, or their legal representatives, acknowledge the risks associated with participation in BAZ\u2019N CAMP activities, including physical injuries. By accepting these Terms and Conditions, they release the association from any liability for injuries occurring before, during, or after the activities.<\/p>\n

<\/p>\n

3. Image Rights Authorization<\/strong><\/p>\n

Participants, or their legal representatives, authorize BAZ\u2019N CAMP to retain, disclose, publish, distribute, or use images (photographs and videos) taken during the camps. This authorization is granted for a period of 10 years from acceptance of these Terms and Conditions, on any medium, including the Internet and the press, for any use that the association deems necessary. Participants assign to the association, free of charge, the exclusive rights of reproduction and representation.<\/p>\n

<\/p>\n

4. Product Prices<\/strong><\/p>\n

Product prices are indicated on the website in euros (\u20ac) and US dollars ($), including all taxes.<\/p>\n

In accordance with Article 19 of the French Law of July 13, 1992, BAZ\u2019N CAMP undertakes to properly perform the obligations arising from the contract entered into with participants. However, the association shall not be held liable for any failure resulting from unforeseeable and unavoidable circumstances attributable to a third party unrelated to the provision of the services covered by the contract, in the event of force majeure, or in the event of the participant\u2019s fault.<\/p>\n

The prices indicated in a brochure, product sheet, or on the website were established based on the information known at the time the documents were printed or the website was updated and may be subject to revision. This clause is drafted in accordance with Article 19 of the French Law of July 13, 1992, which provides that prices stated in the contract may not be revised unless the contract expressly provides for the possibility of a revision.<\/p>\n

<\/p>\n

5. Payment Methods<\/strong><\/p>\n

The following payment methods are available: Credit Card (Stripe and PayPal), Direct Debit, Bank Transfer, Checks, and Cash. We accept ANCV checks, the Coll\u00e9gien de Provence card, and VACAF contributions.<\/p>\n

<\/p>\n

6. Payment Terms<\/strong><\/p>\n

Payment must be made within 10 days following the order. Payment terms vary depending on the program selected:<\/p>\n

    \n
  • USA Destination Camp:<\/li>\n<\/ul>\n

    -Payment in full: The total amount of the camp must be paid within 10 days following the order.<\/p>\n

    -Payment with a deposit: A \u20ac750 deposit must be paid within 10 days following the order. The remaining balance may be paid in up to 5 monthly installments, with full payment required no later than one month before the departure date.<\/p>\n

    \n

      \n
    • Training Camp in France, the Maldives, and the United States:<\/li>\n<\/ul>\n

      -Payment in full: The total amount of the camp must be paid within 10 days following the order.<\/p>\n

      -Payment in installments: The amount may be paid in up to 3 monthly installments, with full payment required no later than one month before the start of the camp.<\/p>\n

      In the event of non-payment and failure to comply with the payment schedule without prior consultation with and approval from the administrative team, the order will be suspended and then canceled within 7 days following the payment default. No refund will be possible.<\/p>\n

      \n

        \n
      • Personalized Support Program:<\/li>\n<\/ul>\n

        The amount of the Personalized Support Program and, where applicable, the Performance Pack Option, must be paid according to the payment terms offered at the time of purchase.<\/p>\n

        In the event of payment by installments, the full amount must be paid during the program period and in accordance with the payment schedule agreed upon at the time of booking.<\/p>\n

        \n

        7. Cancellation Terms and Cancellation Fees<\/strong><\/p>\n

          \n
        • Training Camp in France, the Maldives, and the United States:<\/li>\n<\/ul>\n

          o Up to 60 days before the start of the selected camp session: \u20ac80 cancellation fee for France, $80 cancellation fee for the Maldives, and $120 cancellation fee for the United States (example: an \u20ac80 cancellation fee will be retained for any cancellation made up to and including May 5, 2026, if the selected camp session begins on July 5, 2026).<\/p>\n

          o From 59 to 15 days before the start: 40% of the total amount will be retained (example: 40% of the total amount will be retained for any cancellation made between May 6 and June 20, 2026, if the selected camp session begins on July 5, 2026).<\/p>\n

          o Less than 14 days before the start of the selected camp session or once the camp has started: no refund will be granted (example: no refund will be granted for any cancellation made from June 21, 2026, if the selected camp session begins on July 5, 2026).<\/p>\n

          o No refund request will be accepted in the event of injury or illness occurring during the camp.<\/p>\n

          o The cancellation guarantee (\u20ac25 for Marseille and Paris, $39 for Santa Barbara) allows participants to avoid cancellation fees in the event of an accident or illness making it impossible to practice basketball, the loss of a parent\u2019s employment between registration and the start of the selected camp session, or the death of a parent (legal representative or sibling) between registration and the start of the selected camp session. This guarantee applies until 5 days before the start of the selected camp session (example: 100% of the total registration amount, less the cost of the cancellation guarantee, will be refunded for any cancellation made up to June 30, 2026, upon presentation of valid supporting documentation, if the selected camp session begins on July 5, 2026). After this 5-day deadline, no refund will be possible. The cancellation guarantee does not cover injuries or illnesses occurring during the camp. This guarantee is offered directly by the organization and is not part of any insurance policy taken out with a third party.<\/p>\n

          In the event of payment by credit card, fees related to the use of the card are non-refundable and will be added to the cancellation fees mentioned above.<\/p>\n

            \n
          • USA Destination Camp:<\/li>\n<\/ul>\n

            o Up to 90 days before the start of the camp: \u20ac350 cancellation fee.<\/em>*<\/p>\n

            o From 89 to 46 days before the start of the camp: 60% of the price will be retained.<\/em>*<\/p>\n

            o From 45 days before the start of the camp: no refund will be granted.<\/em>*<\/p>\n

            *In the event of a camp spanning two sessions, the start of the camp refers to the start of the first session.<\/p>\n

            In the event of a visa or ESTA refusal, the camp will not be eligible for a refund.<\/p>\n

            In the event of payment by credit card, fees related to the use of the card are non-refundable and will be added to the cancellation fees mentioned above.<\/p>\n

              \n
            • Personalized Support Program:<\/li>\n<\/ul>\n

              Subject to applicable legal provisions, any cancellation request made within 14 days following purchase may qualify for a full refund. After this period, no refund will be granted for personal convenience or in the event of full or partial non-use of the program.<\/p>\n

              In the event of an injury or physical incapacity preventing the practice of basketball for a period exceeding 4 months, a partial refund may be granted upon presentation of medical documentation. For individual video-conference sessions, the refund will be calculated at \u20ac60 per remaining 1.5-hour session not completed at the time of the request.<\/p>\n

              Services already performed or used will not be eligible for a refund.<\/p>\n

              In the event of absence or late cancellation of an appointment, the appointment may be considered completed. Unless there are exceptional circumstances, any request to reschedule must be made at least 24 hours before the appointment.<\/p>\n

              <\/p>\n

              8. Duration<\/strong><\/p>\n

              Regarding camps in the United States, the stated duration does not mean that the participant will spend the stated number of days and nights in the country. This indication means that we provide services spread over the stated number of days, from the departure flight time on the departure day until the landing time of the return flight on the return day. Generally, the first and last days are dedicated to transportation. Any shortened trip or any service not used by the traveler shall not entitle them to any refund.<\/p>\n

              <\/p>\n

              9. Delivery of Program Documents<\/strong><\/p>\n

              BAZ\u2019N CAMP undertakes to provide participants with all documents relating to the camp program, including information on organization, schedules, activities, and logistical details. These documents will be sent by email or post no later than 5 days before the start of the camp.<\/p>\n

              <\/p>\n

              10. Essential Characteristics of the Products<\/strong><\/p>\n

              The essential characteristics of the Products are described in the information sheets published on the website and are reiterated in the order summary.<\/p>\n

              <\/p>\n

              11. Air Transportation and Flight Delays<\/strong><\/p>\n

                \n
              • Responsibility in the Event of Delays or Cancellations:<\/li>\n<\/ul>\n

                BAZ\u2019N CAMP cannot be held responsible for delays, cancellations, or other flight disruptions caused by airlines. Transportation conditions are governed by the terms and conditions of the airline concerned. In the event of a flight delay or cancellation, BAZ\u2019N CAMP will make every effort to assist participants in managing the consequences, but cannot be held responsible for any additional costs (accommodation, meals, etc.) arising therefrom.<\/p>\n

                  \n
                • Program Modifications:<\/li>\n<\/ul>\n

                  In the event of a flight delay or cancellation, BAZ\u2019N CAMP reserves the right to modify the camp program to adapt to the situation. Participants may not claim any compensation for resulting program modifications.<\/p>\n

                    \n
                  • Participant Responsibility:<\/li>\n<\/ul>\n

                    Participants are responsible for being present at the designated meeting place at the scheduled time for departure. In the event of a no-show or delay caused by the participant, BAZ\u2019N CAMP cannot be held responsible, and no refund will be granted.<\/p>\n

                      \n
                    • Travel Insurance:<\/li>\n<\/ul>\n

                      Participants are strongly advised to purchase travel insurance covering delays, cancellations, and other incidents related to air travel.<\/p>\n

                      <\/strong><\/p>\n

                      12. Liability<\/strong><\/p>\n

                      BAZ\u2019N CAMP endeavors to select reliable service providers (transportation, accommodation, catering, etc.) to ensure the smooth operation of the camps. However, in the event of any problem or failure on the part of these service providers (such as delays, cancellations, lost luggage, accommodation conditions, etc.), BAZ\u2019N CAMP cannot be held responsible for the resulting consequences.<\/p>\n

                      BAZ\u2019N CAMP\u2019s liability is limited to the proper organization of the camp as a whole and shall not cover specific failures by independent service providers. Any complaint relating to services provided by such third parties must be addressed directly to the relevant service provider.<\/p>\n

                      <\/strong><\/p>\n

                      13. Liability in the Event of a Car Accident<\/strong><\/p>\n

                      Participants, or their legal representatives, agree to use public transportation or vehicles belonging to the association to travel to the locations of activities organized as part of the camp.<\/p>\n

                      BAZ\u2019N CAMP cannot be held responsible for any car accident causing personal injury or property damage occurring while using a vehicle owned by BAZ\u2019N CAMP, a vehicle rented by a member of BAZ\u2019N CAMP, or a vehicle owned by a member of BAZ\u2019N CAMP. Furthermore, the driver of the vehicle, whether a member of BAZ\u2019N CAMP or a participant, shall not be held personally liable for such accidents occurring during transportation organized by BAZ\u2019N CAMP.<\/p>\n

                      Participants acknowledge and agree that, in the event of an accident occurring under these circumstances, financial and legal liability will be determined by the insurance policies in place and not by BAZ\u2019N CAMP or the driver of the vehicle.<\/p>\n

                      Participants and their legal representatives are strongly advised to purchase personal insurance covering risks related to transportation by vehicle, including civil liability, bodily injury, and property damage.<\/p>\n

                      <\/strong><\/p>\n

                      14. Recommendation to Purchase Individual Insurance<\/strong><\/p>\n

                      Although BAZ\u2019N CAMP offers insurance for participants covering certain risks during camps and transportation, participants are strongly advised to purchase additional individual insurance. This insurance should include coverage for accidents, repatriation, medical expenses, cancellation, loss of luggage, and other incidents that may occur during the stay. BAZ\u2019N CAMP cannot be held responsible for costs or consequences relating to events not covered by the collective insurance arranged by the association.<\/p>\n

                      <\/strong><\/p>\n

                      15. Personal Liability Insurance Certificate<\/strong><\/p>\n

                      Participants, or their legal representatives, certify that they are covered by personal civil liability insurance covering risks related to their participation in the activities offered by BAZ\u2019N CAMP, including transportation, accidents, and damages that may occur during the camp. This insurance must cover civil liability for damage caused to third parties, as well as personal injuries.<\/p>\n

                      BAZ\u2019N CAMP cannot be held responsible for property damage or personal injury caused to participants or third parties that is not covered by this personal insurance. Participants undertake to provide, upon request, proof of their civil liability insurance coverage before the start of the camp.<\/p>\n

                      <\/strong><\/p>\n

                      16. Conduct and Dismissal<\/strong><\/p>\n

                      Participants, or their legal representatives, agree that any behavior disrupting the proper operation of the camp may result in dismissal without any right to a refund. Interruption of the stay due to injury or illness shall not entitle the participant to any refund.<\/p>\n

                      <\/strong><\/p>\n

                      17. Organized Outings<\/strong><\/p>\n

                      Participants, or their legal representatives, agree to participate in the weekly outing organized by BAZ\u2019N CAMP, particularly in the Calanques, at the beach, and in the city center (Paris, Marseille, and Santa Barbara). This activity takes place during the daytime each week of the camp.<\/p>\n

                      <\/strong><\/p>\n

                      18. Emergency Medical Intervention<\/strong><\/p>\n

                      Participants, or their legal representatives, grant full authority to BAZ\u2019N CAMP, through its director and activity leaders\/chaperones, to make any necessary decisions in the event of emergency medical intervention (surgery, X-ray, ultrasound, anesthesia, medical treatment). Participants shall assume full financial responsibility for any expenses incurred and reimburse the association at the end of the stay.<\/p>\n

                      <\/strong><\/p>\n

                      19. Liability in the Event of Lost Keys and Cleaning Fees<\/strong><\/p>\n

                      Participants, or their legal representatives, undertake to reimburse BAZ\u2019N CAMP a flat fee of \u20ac90 in the event of loss of the keys to the accommodation provided, in order to cover replacement costs. They also undertake to pay a \u20ac50 cleaning fee if the room is returned in an insufficient state of cleanliness.<\/p>\n

                      <\/strong><\/p>\n

                      20. Administrative Formalities<\/strong><\/p>\n

                      The various administrative and health formalities required to participate in the camp, such as obtaining passports, ESTA authorizations, visas, vaccinations, or any other required authorization, are the responsibility and sole responsibility of the participant (or their legal representatives). The participant is responsible for obtaining information from the relevant administrative authorities regarding the specific formalities applicable before departure.<\/p>\n

                      In the event that the necessary documents or authorizations (passport, ESTA, visa, vaccinations, etc.) are not obtained, BAZ\u2019N CAMP cannot be held responsible for the participant\u2019s inability to attend the camp. No refund will be granted in such circumstances, and the full amount due shall remain payable.<\/p>\n

                      <\/strong><\/p>\n

                      21. Modification at the Participant\u2019s Request<\/strong><\/p>\n

                      Any request to modify your order must be made by email to the following address: contact@bazncamp.com. BAZ\u2019N CAMP will reply by email with the requested modification and the applicable fees for your acceptance.<\/p>\n

                      After you have accepted the modification and paid the corresponding fees, you will receive confirmation of the modification by email. In the absence of an email confirmation issued by BAZ\u2019N CAMP, the modification has not been taken into account. It is therefore your responsibility in all cases to ensure that you have received the confirmation email. Otherwise, please contact us by email at contact@bazncamp.com or by telephone at +33 7 49 67 22 51 \/ +1 909 568 4530 to follow up on this modification.<\/p>\n

                      <\/strong><\/p>\n

                      22. Cancellation by the Organizer<\/strong><\/p>\n

                      The participant shall not be entitled to any compensation if the cancellation of the trip or training camp is required due to force majeure, recurring climatic or natural events (monsoon, cyclone, etc.), or circumstances that may make it impossible to benefit from certain services for reasons relating to participant safety.<\/p>\n

                      <\/strong><\/p>\n

                      23. Right of Withdrawal<\/strong><\/p>\n

                      In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to leisure services that must be provided on a specific date or during a specific period. Consequently, registrations for training camps organized by BAZ\u2019N CAMP, whether in France or in the United States, are not subject to the right of withdrawal.<\/p>\n

                      With regard to the Personalized Support Program, the statutory provisions relating to the right of withdrawal applicable to distance contracts shall apply. Where applicable, if the performance of the program begins before the expiry of the statutory withdrawal period at the participant\u2019s express request, the statutory provisions relating to the early performance of the service shall apply.<\/p>\n

                      The cancellation and refund terms specific to the Personalized Support Program are set out in Article 7 of these Terms and Conditions.<\/p>\n

                      <\/strong><\/p>\n

                      24. Legal Guarantee of Conformity and Guarantee Against Hidden Defects<\/strong><\/p>\n

                      In accordance with applicable law, BAZ\u2019N CAMP reminds consumers that they benefit from the legal guarantee of conformity provided for under Articles L217-4 et seq. of the French Consumer Code, as well as the guarantee against hidden defects provided for under Articles 1641 et seq. of the French Civil Code. However, these guarantees apply only to physical products that may be sold by the association. Services, such as training camps, are not covered by these guarantees, but BAZ\u2019N CAMP undertakes to provide the services in accordance with the description provided and the reasonable expectations of participants.<\/p>\n

                      <\/strong><\/p>\n

                      25. Complaints<\/strong><\/p>\n

                      Complaints may be submitted to the Seller using the contact details provided in the Legal Notices section, by completing the contact form in the Contact section, or by email at contact@bazncamp.com. The Seller will endeavor to process complaints as quickly as possible and provide an appropriate response.<\/p>\n

                      <\/strong><\/p>\n

                      26. Applicable Law<\/strong><\/p>\n

                      French law governs the pre-contractual relationship between the Client and the Seller, as well as these General Terms and Conditions and any contract entered into between the Client and the Seller through the website.<\/p>\n

                      <\/strong><\/p>\n

                      27. Acceptance of the Terms and Conditions<\/strong><\/p>\n

                      By signing these Terms and Conditions, participants or their legal representative declare that they have read and understood all of the terms and conditions and accept them without reservation.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/section>\n
